Wadsworth v. State

In Wadsworth v. State, 275 Mont. 287, 306, 911 P.2d 1165, 1176 (1996), the Department of Revenue had terminated Wadsworth for refusing to give up his outside employment. The Montana Supreme Court held that the opportunity to pursue employment is a constitutionally protected fundamental right, and that Wadsworth was discharged for exercising that right in violation of public policy.
