Badberg v. Badberg

In Badberg v. Badberg, 193 Neb. 844, 229 N.W.2d 552 (1975), the trial court denied an award of attorney fees. The Badberg court affirmed, reasoning that the trial was a simple one, the parties were the only witnesses sworn, the record covered only 62 pages, and the trial court took into consideration that one party used marital funds to pay attorney fees. The Badberg court stated that while it would have made an additional allowance, it could not say the trial court abused its discretion in not doing so.
