Bindrum v. Foote & Davies

In Bindrum v. Foote & Davies, 235 Neb. 903, 457 N.W.2d 828 (1990) the plaintiff had back trouble and claimed he could not work, but the medical evidence showed no objective symptoms and the medical opinion for his injury was weak. He was denied TTD by the trial court after a certain date. The court reviewed the evidence and concluded that the record supported an inference that the plaintiff had reached MMI on a certain date previous to the date determined by the trial court and that a stipulation of the parties justified the award of TTD after that date to the date to which the trial court had allowed TTD. The Bindrum court said there was nothing clearly wrong in that determination.
