Eugenis v. Felipe

In Eugenis v. Felipe, NYLJ, March 14, 2001, at 21, col 6 (Civ Ct, Kings County), a former co-tenant, who claimed that she had not lived in the subject premises for several years, moved to vacate a default judgment that had been entered against her by the Housing Court in a nonpayment proceeding. While the court noted that the matter had been transferred by the Housing Court to the Civil Court "as there was no longer an issue of possession," there was no discussion regarding whether the Housing Court had jurisdiction to entertain that motion and no holding that it did not.
