Vincent Z. v. Dominique K

In Vincent Z. v. Dominique K., 62 AD3d 402, 879 N.Y.S.2d 70 (2009), the Court noted that a review of the record of the open court proceedings regarding the proposed settlement agreement indicated that the parties intended to give the court power to modify the parties' child support obligation once the respondent-mother obtained full time employment. The Support Magistrate ultimately found that respondent-mother's five-fold increase in earnings constituted a change in circumstances warranting a downward modification. There was a reservation of jurisdiction and incorporation for possible modification for subsequent employment.
