Zwinge v. Love

In Zwinge v. Love (37 AD2d 874, 325 N.Y.S.2d 107 [3rd Dept 1971]), the Court declined to impose liability on the defendant parents of the owner of the dog who did not reside on the premises, but nonetheless owned the premises. In Zwinge, the Court found "no evidentiary showing indicating that defendant owner but non-resident of the premises harbored or kept the dog," (id.)
