Examples of charge reduced from murder to manslaughter based on provocation

In State v. Bishop, 225 N.J. Super. 596, 543 A.2d 105, 106 (N.J. Super. Ct. App. Div. 1988), the provocation involved a mob scene of 15 to 20 people engaged in a brawl, the court found that defendant might have been acting in defense of his nephew. In State v. Washington, 223 N.J. Super. 367, 538 A.2d 1256 (N.J. Super. Ct. App. Div. 1988), the court held that the defendant was entitled to a manslaughter instruction based on the provocation defense because the victim, in his struggle with defendant, showed him a knife.
