Matter of Baby M

In Matter of Baby M., (109 NJ 396, 537 A2d 1227 [1988]), a surrogate who had entered into an agreement with a husband and wife who could not conceive, and who contributed her own genetic material, changed her mind after the baby's birth and sought parental rights. (109 NJ 396, 537 A2d 1227.). The Baby M. court invalidated the surrogacy contract as against public policy, granted custody to the birth father, voided the termination of the surrogate's parental rights, voided the baby's adoption by the birth father's wife, and awarded visitation rights to the surrogate.
