Can Compensatory Damages Be Awarded for Humilation Suffered As a Result of Housing Discrimination ?
In Allison v. Pennsylvania Human Rels. Comm'n, 716 A.2d 689 (Pa. Cmwlth. 1998), this Court approved an award of $ 8,000.00 in compensatory damages for humiliation suffered as a result of housing discrimination in violation of Section 5(h)(1) of the Act, 43 P.S. 955(h)(1).
In determining whether the evidence of emotional distress is sufficient to support an award, we look at both the direct evidence of emotional distress and the circumstances of the act that allegedly caused the distress. United States v. Balistrieri, 981 F.2d 916 (7th Cir. 1992).
