Miller v. Brass Rail Tavern, Inc

In Miller v. Brass Rail Tavern, Inc., 541 Pa. 474, 664 A.2d 525 (Pa. 1995), the Supreme Court of Pennsylvania held that a trial court erred by precluding the expert testimony of a coroner as to the time of death of the plaintiff's decedent. Significantly, even though the plaintiff had failed to disclose during discovery that the coroner would be called as an expert witness and had failed to disclose the contents of his testimony, the plaintiff had revealed that the coroner would be a fact witness.
