Tompkins v. Zoning Bd. of Review of the Town of Little Compton

In Tompkins v. Zoning Bd. of Review of the Town of Little Compton, C.A. 02-0204 (October 29, 2003), plaintiff challenged a zoning board's review purporting to uphold an Officer's determination that the town could not enforce its zoning ordinance as against that portion of a lot that lay beyond state lines. The Court concluded that the board exceeded its statutory authority by purporting to create a binding decision through an unauthorized review process.
