Clark v. St. Thomas Hosp

In Clark v. St. Thomas Hosp., 676 S.W.2d 347, 349 (Tenn. Ct. App. 1984), the appellate court affirmed the trial court's admission of a videotape in which a hospital technician reenacted with a third party her testimony that she lowered the plaintiff to the floor when his knees buckled. The court noted that witnesses often reenact their testimony in front of the jury at trial, that the witness's sworn testimony remains the fundamental evidence for the jury's consideration, and that the plaintiff was able to cross-examine the technician. Id. at 349-50.
