State v. Morgan

In State v. Morgan, 541 S.W.2d 385 (Tenn. 1976), a pre-Tennessee Rules of Evidence case, the supreme court adopted Federal Rule of Evidence 609 as the standard for witness impeachment with prior convictions. Federal Rule 609 as adopted in Morgan provided in pertinent part, "Evidence of a conviction under this rule is not admissible if a period of more than ten years has elapsed since the date of the conviction or of the release of the witness from the confinement imposed for that conviction . . . ." Morgan, 541 S.W.2d at 389 (quoting Fed. R. Evid. 609(b)) .
