In Alaghehband v. Abolbaghaei, No. 03-02-00445-CV (Tex. App.--Austin May 1, 2003, no pet.) (mem. op.) (not designated for publication), the wife was awarded about $ 118,000.00 in community assets. The appellate court noted that several of the assets were retirement accounts and that the tax consequences and long-term financial consequences of early withdrawal would render the liquidity of the assets problematic. The court then stated the spouse would exhaust the liquid assets she was awarded (approximately $ 85,000.00) within two years.
