Anchor Advertising, Inc. v. Burt

U-Anchor Advertising, Inc. v. Burt, 553 S.W.2d 760, 763, 20 Tex. Sup. Ct. J. 435 (Tex. 1977), involved a contract dispute over a contract that was "solicited, negotiated, and consummated" in Oklahoma. In determining that the nonresident in that case had not purposefully conducted activities within Texas, the supreme court noted that the nonresident was merely "a passive customer of a Texas corporation who neither sought, initiated, nor profited from his single and fortuitous contact with Texas." Id.
