Anthony Equipment Corp. v. Irwin Steel Erectors, Inc

In Anthony Equipment Corp. v. Irwin Steel Erectors, Inc., 115 S.W.3d 191 (Tex. Ct. App. 2003), the Texas Court of Appeals noted that "two employers can contractually agree to assign 'right of control'" and that with such an agreement "the court can decide the borrowed servant issue without considering the facts and circumstances of the project." Id. at 200. The court did not find an express assignment of the right of control in that case because the work order memorializing the oral agreement did not include a clause relating to supervision and control. Id.
