In Atlas Copco Tools, Inc. v. Air Power Tool & Hoist, Inc., 131 S.W.3d 203, 209 (Tex. App.--Fort Worth 2004, pet. denied), the Fort Worth court of appeals found the evidence in support of lost profits legally insufficient. 131 S.W.3d at 209. The court's conclusion rested, in part, on the inclusion of "customers that appellee decided to stop selling to or relinquish, that were not part of appellee's territory under the agreement, and that refused to purchase appellant's product through appellee due to dissatisfaction with appellee's service." Id. at 208-09.
