Balentine v. State

In Balentine v. State, 71 S.W.3d 763, 769 (Tex. Crim. App. 2002), the officer arrived on the scene of a shots-fired call. He observed the defendant walking across the street nearby the complainant's residence. Id. It was approximately 2:30 in the morning in what the officer described as a residential, low-traffic area. Id. The defendant appeared nervous and was walking briskly away from the reported direction of the gunfire, while constantly looking back over his shoulder in the officer's direction. The officer's detention of the defendant was found to have been justified. Id.
