In Beadles v. Lago Vista Prop. Owners Ass'n, No. 03-05-00194-CV (Tex. App.--Austin May 18, 2007, no pet.) the Court reiterated our previous holding that the voting structure was not illegal because it did not violate the Non-Profit Corporations Act and determined Beadles was barred by res judicata from bringing the same claim. Id. But the Court went on to state that "if this Court had determined that the voting procedures were not allowed under the Act, we would have had to address Beadles's claim of a continuing breach that would have tolled the statute of limitations." Id.
