Beistel v. Allen

In Beistel v. Allen, No. 01-06-00246-CV, 2007 WL 1559840 (Tex. App.--Houston 1st Dist. May 31, 2007, no pet.), Allen filed a suit seeking to terminate wage-withholding orders for child support because both of his children were over the age of 18. Id. Beistel, Allen's ex-wife, resided out of state and filed a special appearance, which the trial court granted. Id. After the trial court granted Beistel's special appearance, Beistel's counsel attended the termination hearing, during which she objected to an exhibit that Allen offered into evidence to support his position on the merits of the case. The Court stated, "Counsel's participation in the hearing was inconsistent with the assertion in Beistel's special appearance that the trial court lacked jurisdiction over her." Id. The Court held, "The appearance and participation of Beistel's counsel at the termination hearing constituted a general appearance." Id.
