Beller v. State

In Beller v. State, 635 S.W.2d 739 (Tex. Crim. App. Panel Op. 1982), the weapon used during a robbery was never introduced into evidence, and there was no testimony describing the knife or its size. Beller, 635 S.W.2d at 740. The court concluded the evidence was insufficient to prove it was a deadly weapon. Id.
