Bland Independent School District v. Blue

In Bland Independent School District v. Blue, 34 S.W.3d 547 (Tex. 2000), a standing case, the court stated that there are times when a plaintiff must produce evidence to prove jurisdiction in response to a defendant's jurisdictional challenge. 34 S.W.3d at 554. Specifically, the court in Bland relied on the fact that the plaintiff did not dispute the veracity of certain evidence produced by the defendant. Id. at 555. The court, indeed, took that evidence as conclusive of certain essential facts. Id. at 555-56.
