Blum v. Julian

In Blum v. Julian, 977 S.W.2d 819, 823 (Tex. App.--Fort Worth 1998, no pet.), Blum filed a lawsuit against Julian. Blum, 977 S.W.2d at 821. Julian moved for summary judgment providing affidavits as summary judgment proof. Id. Blum objected to Julian's affidavit. Id. at 823. Without expressly ruling on Blum's objections, the trial court granted summary judgment for Julian. Id. at 821. The court of appeals concluded that the fact that the trial court granted Julian's motion for summary judgment created an inference that Blum's objections had been implicitly overruled. Blum, 977 S.W.2d at 823-24. In Blum v. Julian, Julian's affidavits were her only summary judgment evidence. Id. at 821.
