Brem v. State

In Brem v. State, 571 S.W.2d 314, 321 (Tex. Crim. App. 1978), the court held that the trial court did not err in denying the defendant's request to require prosecutors to investigate evidence regarding similar incidents that happened after the defendant's incarceration. The court stated that even if appellant had evidence that crimes similar to the one for which he was on trial had been committed after he was in custody, this would not be inconsistent with his guilt of the offense, in light of the victim's positive identification of him as her assailant and other circumstantial evidence of his guilt. Id. at 322.
