City of Corpus Christi v. Ferguson

In City of Corpus Christi v. Ferguson, No. 13-12-00679-CV (Tex. App.--Corpus Christi Feb. 6, 2014, no pet.), the plaintiff spent the night on her family's sailboat, planning to participate in a boat parade the next day. In the morning, she walked to the marina's bathroom facility to take a shower. She slipped and fell on the pier as she walked back to the sailboat from the bathroom. Id. Rejecting the plaintiff's contention that she was not engaged in recreation when she fell but merely was walking back to her boat, the court held her use of the marina's shower facilities was "an inseparable part" of her activity of camping overnight in the boat, and a part of her "broader boating-camping activities." Id.
