City of Dallas v. Albert (2006)

In City of Dallas v. Albert, 214 S.W.3d 631, 633 (Tex. App.--Dallas 2006, pet. filed), Dallas firefighters brought suit, on theories including breach of contract, to recover wages allegedly due them because the City allegedly violated a municipal ordinance requiring it to maintain a percentage pay differential between various grades of firefighters. Because Tex. Loc. Gov't Code section 271.151 et seq. was enacted during the pendency of the Albert appeal, we remanded the case "to allow the firefighters the opportunity to argue that the legislature has waived the City's immunity from suit by these new statutory provisions." Id. at 636-37.
