City of Galveston v. Gray

In City of Galveston v. Gray, 93 S.W.3d 587 (Tex.App.--Houston 14th Dist. 2002, pet. denied), two governmental defendants filed pleas to the jurisdiction. Gray, 93 S.W.3d at 589. The trial court granted the plaintiff's motion to continue a hearing on the pleas and allowed her to conduct discovery on liability. Id. The governmental entities filed an interlocutory appeal, contending that the trial court had implicitly denied the pleas to the jurisdiction. Id. at 590. The appellate court held that it lacked jurisdiction over the interlocutory appeal because the trial court expressly stated that it was not ruling on the pleas to the jurisdiction. Gray, 93 S.W.3d at 590.
