Columbia Medical Center of Las Colinas v. Bush ex rel. Bush

In Columbia Medical Center of Las Colinas v. Bush ex rel. Bush, 122 S.W.3d 835 (Tex. App.--Fort Worth 2003, pet. denied), the Fort Worth Court of Appeals interpreted the phrase "signed or subject to an appeal on or after the effective date of the Act." Bush, 122 S.W.3d at 865. Applying the plain meaning of this phrase to discern the intent of the Legislature, the court concluded that the amendment applied to cases where a judgment is signed on or after the effective date of the act and "to cases where a judgment becomes subject to appeal, i.e., capable of being appealed, on or after the effective date of the Act." Id.
