Deltuva v. Deltuva – Case Brief Summary (Texas)

In Deltuva v. Deltuva, 113 S.W.3d 882, 888-89 (Tex. App.--Dallas 2003, no pet.), the Fifth Court of Appeals reversed a trial court's award of spousal maintenance because the award's duration was longer than three years, but otherwise approved the general decision to award spousal maintenance.

The court noted the wife was awarded "the majority of the marital estate," id. at 888, but found there was evidence in the record to support the conclusion that the recipient spouse's living expenses would significantly exceed her income (even after exhaustion of her savings).
