Donna Indep. Sch. Dist. v. Gracia

In Donna Indep. Sch. Dist. v. Gracia, 286 S.W.3d 392 (Tex. App.--Corpus Christi 2008, no pet.), Gracia was terminated from his position and requested a hearing pursuant to the Texas Education Code. Id. at 393. Before the hearing, Gracia entered into a settlement agreement with the school district. Id. Gracia later sued the school district for breach of the settlement agreement. Id. The court held that the school district's sovereign immunity was not waived under section 271.152 because Gracia settled while his case was pending in the statutory administrative process. See id. at 395.
