In Ex parte Fassi, 388 S.W.3d 881 (Tex. App.--Houston 14th Dist. 2012, no pet.), the Court affirmed denial of habeas relief based on lack of sufficient prejudice where the evidence of guilt in the applicant's underlying marijuana possession case was "overwhelming." 388 S.W.3d at 888. There, the officer who conducted the traffic stop averred that the applicant smelled of marijuana and had marijuana flakes on his shirt, and then confessed to having marijuana in the vehicle. Id.
