Glass v. Smith

In Glass v. Smith, 150 Tex. 632, 244 S.W.2d 645 (Tex. 1951), several members of the City of Austin fire department signed an initiative petition to call an election on a proposed ordinance concerning employment issues. 244 S.W.2d at 647. The Texas Supreme Court affirmed a writ of mandamus requiring city authorities to hold an election after the requisite number of signatures were collected. See id. at 648, 653-54. The court held that the plaintiffs, as petition signers, had a justiciable interest in ensuring their proposed ordinance was submitted to the electorate. See id.
