''Not Accurate'' Court Testimony About Stolen Car Color

In Winn v. State, 828 S.W.2d 284, 286 (Tex.App.--Houston [14th Dist.] 1992) the police caught the defendant driving what they described as a blue and brown Chevy Astro van. See id. The owner of the van testified that it was a blue and grayish Chevy Astro. See id. The court of appeals held the evidence insufficient, noting that there was no evidence that the van the police seized had the same licence number or vehicle identification number as the owner's van, that the owner never identified the stolen van in the pound after it was impounded, and that the description of the color of the van differed. See Winn, 828 S.W.2d at 286.
