Time to File Objection to An Expert Witness In a Medical Malpractice Case In Texas

An objection to the qualifications of an expert witness in a medical malpractice case must be made no later than 21 days after the date the objecting party receives a copy of the witness's curriculum vitae or the date of the witness's deposition. TEX. REV. CIV. STAT. ANN. art. 4590i, 14.01(e) (Vernon Supp. 2000). A party is permitted to object after the expiration of this 21-day period only when the basis for the objection arises after the expiration date, and the basis of the objection could not have been reasonably anticipated.
