Werner v. State

In Werner v. State, 711 S.W.2d 639 (Tex. Crim. App. 1986), Werner sought to admit expert testimony on the "holocaust survivors' syndrome" in support of his claim of self-defense. The court held, however, that Werner, an adult who had no prior relationship with the deceased, had not presented evidence that he reasonably believed it necessary to shoot the deceased to defend himself against deadly force. Id. at 644-45. The court held that Werner was not entitled to admission of the expert testimony because the evidence did not raise self-defense as an issue. Id. at 645.
