In re Sylvester

In In re Sylvester (9th Cir. BAP 1998) 220 B.R. 89, the court found that the settlement was entered into in exchange for dismissing the debtor's claims, which included a claim for 'emotional distress' and therefore, that portion of the funds recovered in the malpractice action were properly attributable to the settlement of the debtor's 'personal injury' claim.
