United States v. Palma-Ruedas
In United States v. Palma-Ruedas, 121 F.3d 841 (3rd Cir 1996), the Court affirmed the District Court's exclusion of testimony that a witness named Hernandez had said,"nice to meet" you when introduced to a person named Avenando.
The proponent wanted to use the statement as evidence that the two had not previously met.
The Court concluded that use of the statement was improper because "statements offered to support an implied assertion are inadmissible hearsay." Id. at 857 (citing United States v. Reynolds, 715 F.2d 99 , 104 (3rd Cir. 1983)).
