Brooks v. United States

In Brooks v. United States, 337 U.S. 49, 52-54, 69 S.Ct. 918, 93 L.Ed. 1200 (1949), the Supreme Court held that servicemen on leave from active duty could sue under the Federal Tort Claims Act (FTCA) to recover for injuries sustained on a public highway inflicted by a government employee driving a truck belonging to the United States at least when the injuries were not incident to or caused by military service.
