In Allen v. Federated Dairy Farms, Inc., 538 P.2d 175, 177 (Utah 1975) the Court focused on the issue of notice and held that the plaintiff failed to establish that the store owner had any constructive notice of spilled cottage cheese on which a customer slipped; therefore, the owner could not be liable under a temporary unsafe condition theory.
