Kennecott Corp. v. State Tax Comm'n

In Kennecott Corp. v. State Tax Comm'n, 814 P.2d 1099, 1100 (Utah 1991), the Court explained that an order can meet this finality requirement only if it relies on facts different from those underlying the other claims. Thus, finality depends on the "'degree of factual overlap'" between the order appealed from and the claims remaining before the lower court.
