Sperry v. Sperry

In Sperry v. Sperry, 1999 UT 101, 7, 990 P.2d 381, the Court determined that the plaintiff's "wrongful death claim submitted to the insurer was not based upon her own coverage but on her husband's liability coverage for negligence." Id. Thus, the Court concluded that the plaintiff could not be considered a party to the insurance contract for purposes of her bad faith action against the insurer since the insurer, in its capacity as the liability insurer of her husband, owed her no contractual good faith duties to settle her claim. Id.
