State v. Cantu

In State v. Cantu, 750 P.2d 591 (Utah 1988), the first case decided by the Court under the Batson framework, the timeliness of the defendant's Batson challenge was not at issue because the defendant had moved to quash the entire jury panel on fair cross-section grounds before the prosecution's peremptory challenges were even exercised, and he apparently renewed the objection immediately after the prosecution exercised a peremptory strike to remove a minority jury member.
