In State v. Shondel, 22 Utah 2d 343, 453 P.2d 146 (Utah 1969), the Court held that where two statutes define exactly the same penal offense, a defendant can be sentenced only under the statute requiring the lesser penalty. Id. The doctrine necessarily applies only when the two statutes address "exactly the same conduct."
