Jarvis v. Gillespie

In Jarvis v. Gillespie, 155 Vt. 633, 587 A.2d 981 (1991), the Court considered whether 12 V.S.A. 462 automatically applies to any parcel of land owned by a municipality, no matter whether the land was open for a public use. The Court held that under some circumstances a fact finder could determine that a municipal property is not "given to a public use" and, in such case, the land would not be exempt by 462 from a claim of adverse possession. Id. at 642-43, 587 A.2d at 987-88.
