In State v. Derouchie, 153 Vt. 29, 35, 568 A.2d 416, 419 (1989), the Court concluded that the trial court had exercised its discretion under Rule 403 based on the trial court's statement that it was "going to let in the cocaine evidence." The Court concluded that the record did not indicate that the prejudicial effect of the admitted evidence "so overweighed the probative value that the evidence should have been excluded as a matter of law." Id.
