In Dewing v. Cooper, 33 Wis. 2d 260, 147 N.W.2d 261 (1967) the defendants conceded that the res ipsa loquitur doctrine applied. See id. at 265.
Therefore, the case boiled down to whether the defendants' proofs successfully rebutted the inference of negligence.
