Keip v. DHFS

In Keip v. DHFS, 2000 WI App 13, 232 Wis. 2d 380, 384, 606 N.W.2d 543 (Ct. App. 1999), the Court reviewed a denial of MA benefits that was challenged in a fair hearing before a DHA hearing examiner. In Keip, the hearing examiner issued a proposed decision, but the DHFS rejected the hearing examiner's reasoning and issued its own final decision. Id. at 384-86. The Court applied the deference analysis to the DHFS decision and not to the hearing examiner's decision. See id. at 390-92.
