Hopkinson v. State

In Hopkinson v. State, 632 P.2d 79 (Wyo. 1981) the prosecution introduced statements made by the victim prior to his death. The Court stated that in order to comply with the requirements of the Confrontation Clause the prosecution must provide sufficient background information concerning the circumstances under which the hearsay statements were made to provide the jury with an adequate basis to evaluate its veracity. In that case, the prosecutor established the history and circumstances surrounding the giving of the statement and provided evidence of the defendant's character. Hopkinson, 632 P.2d at 134.
