Vigil v. State

In Vigil v. State, 859 P.2d 659 (Wyo. 1993), the Court held that a jury instruction that reflected a repealed statute constituted reversible error, even though defense counsel had proffered the instruction. Id. at 664. The rationale that "inaccurate jury instructions on a specifically repealed statute, resulting in a possible conviction without proof beyond a reasonable doubt of all present elements of a crime, cannot be excused as invited error or harmless error" is not applicable here. Id.
